Ordinance 520 – 540 | Operation of Vehicles, Parking

  1. 1 OPERATION OF VEHICLES
    SECTION ONE: Every vehicle operated within the city limits shall be so equipped as to make a minimum of noise, smoke or other nuisance, to protect the rights of other traffic and to promote public safety.
    SECTION TWO: The operator of any vehicle upon the streets of Moorland shall operate said vehicle in a careful manner, with regard for the safety and convenience of pedestrians and other vehicles upon such streets.
    SECTION THREE: No operator of a vehicle shall drive such a vehicle off the paved roadway surface for any reason other than parking or entering an established driveway.
    SECTION FOUR: No operator of a vehicle upon a street of Moorland shall drive at a greater speed than is reasonable and prudent, having regard for the traffic, both pedestrian and motor traffic, and the condition of the street. Where no condition exists that requires a lower speed for compliance with this section, the speed of any vehicle shall not be in excess of 25 mph.
    SECTION FIVE: No person shall engage upon the streets in vehicle racing, “drag racing”, or any other form of com­petition involving motor vehicles. Any person found guilty of violating this section will be presumed guilty of violating sections two and four of this ordinance also.
    SECTION SIX: The driver of a vehicle shall come to a complete stop in obedience to a stop sign at an intersection and then shall proceed cautiously, yielding to vehicles not so obliged to stop which are within the intersection or approaching so closely as to constitute an immediate hazard.
    SECTION SEVEN: When turning to the right at an intersection, vehicles shall keep to the right of the center, and in turning to the left shall pass to the left of the center, keeping as far to the right as is possible to do so and still pass to the left of the center.
    SECTION EIGHT: The lights of a vehicle shall be illuminated during the period required by KRS 189.030.
    SECTION NINE: No vehicle shall be parked in such a manner as to have more than two (2) of its wheels on the street surface, nor shall any vehicle be parked so that more than three-fourths of its width projects into the roadway. (a) A vehicle parked in compliance with this section must also be parked facing in the same direction as the normal flow of traffic.
    SECTION TEN: No vehicle shall be left unattended on the streets of the City so as to obstruct the normal movement of traffic.
    SECTION ELEVEN: Any person violating any section of the foregoing shall be punishable by a fine of not less than $2.50 nor more than $20.00. One set of facts may constitute a violation of two (2) or more sections of this ordinance and the fines for the same may be cumulative.

520.2 OPERATION OF VEHICLES – AMENDS 520.1
SECTION ONE: Section four of Ordinance 520.1 is amended to incorporate the uniform fine schedule for speeding violations as set forth in KRS 189.394.
SECTION TWO: A new sentence is amended to Section five of Ordinance 520.1 which reads: “The minimum fine to be imposed upon violation of this section is $50.00”
540.1 PARKING
SECTION ONE: All automobiles and trucks parked on the streets of the City of Moorland shall have the right two wheels on the shoulder of the roadway and the left two wheels on the roadway.
SECTION TWO: It shall be unlawful to park an automobile, truck, or other vehicle in the City of Moorland on other than paved driveways or on roadways as prescribed in Section One hereinabove.
SECTION THREE: For the purpose of this ordinance, paved shall mean: asphalted, concreted, graveled, or similar construction.
SECTION FOUR: It is further ordained that anyone who violates provisions of Sections One and Two of this ordinance shall be punished for such violations by a fine of not less than Ten ($10.00) dollars or more than One Hundred ($100.00) dollars for each offense. Each citation shall constitute a separate violation.
Amend as follows:

    SECTION ONE: All automobiles and trucks
    parked on the streets of the City of Moorland shall have the right two wheels
    on the shoulder of the roadway and the left two wheels on the roadway.
    SECTION TWO: It shall be unlawful to park
    an automobile, truck, or other vehicle in the City of Moorland on other than
    paved driveways or on roadways as prescribed in Section One herein above.
    It is shall be further ordained that it is unlawful for any oerson to park an
    automobile, truck, or other vehicle over or on installed speed humps. Speed
    humps are considered a traffic safety device and shall be clear at all times.
    SECTION THREE: [For the purpose of this
    ordinance, paved shall mean: asphalted, concreted, graveled, or similar
    construction.] For the purpose of this ordinance, paved shall mean:
    asphalt, concrete, or similar aggregate. Loose gravel shall not be
    permitted.* (Please see note below)
    SECTION FOUR: It is further ordained that anyone who violates provisions of
    Sections One and Two of this ordinance shall be punished for such
    violations by a fine of not less than Ten ($10.00) dollars or more than One
    Hundred ($100.00) dollars for each offense. Each citation shall constitute a
    separate violation. issued a citation for the violation along with a fine of not
    less than $50.00 (fifty dollars) and not more than $100.00 (one hundred
    dollars). Each violation shall be considered a separate fine. Fines shall be
    paid in full by money order or certified check payable to City of Moorland
    within 10 (ten) business days of receipt of citation. Unpaid fines after 30
    (thirty) day shall accrue interest at the rate of 25% (twenty-five percent), to
    be compounded weekly. Continued violations may result in towing of the
    vehicle at the owners expense. In addition, further penalties up to and
    including liens placed on the violators property may be executed.

*Any existing loose gravel driveway shall be grandfathered, properly maintained, and an exception to this ordinance; however, any new driveway construction shall adhere to the ordinance as amended.

(540.2) ORDINANCE NO. B SERIES 1977
AN ORDINANCE AMENDING ORDINANCE 1974-1 RELATING TO THE PARKING OF VEHICLES
Whereas the City of Moorland is authorized to carry out all laws relating to cities of the sixth class and to enact ordinances for safety, health and welfare within the City not in conflict with general laws.
THE BOARD OF TRUSTEES OF THE CITY OF MOORLAND, KENTUCKY, DOES ORDAIN AS FOLLOWS:
1 A new section 5 is added to Ordinance 1974-1 which reads as follows: A person cited for unlawful parking as described above may elect to pay without court action the minimum fine of $10.00 but must do so within five (5) days of the violation. The person should then mail the citation plus a check for $10.00 to the City Clerk of the City of Moorland.
2 This ordinance shall be effective immediately after its acceptance, approval and publication as required by law.

ADOPTED THIS 20th DAY OF DECEMBER 1977.
